Q: A group of us have been maintaining a slalom course on a public lake for many years now. The lake is owned by a utility company, which is concerned about the potential liability that this course could involve. One possible solution would be for our group of skiers to purchase an insurance policy to cover the expenses in the event of some kind of a lawsuit. Is it possible for a group to insure a slalom course?

A: Yes, it is possible to purchase an insurance policy to protect your ski group as well as the interests of the utility company against lawsuits arising out of skiing activities. You do not, however, assign a value to the slalom course, as you are not insuring it against physical damage. You are only trying to protect your “club” against liability.
I suggest checking into the AWSA membership program (800-533-AWSA) and affiliating your group as a member club. As a member club, one of the many benefits is the Club Liability insurance, which provides $1,000,000 of coverage for club activities. Club activities include the potential liability arising out of placement and use of your club's slalom course.
